Appeal Grounds
Appeals to the Board of Studies must include a letter based on one or more of the Grounds for Appeal (Appeal Regulation 3.4). What are the grounds you are basing your appeal on?
- The Associate Dean's decision did not follow the rules of procedural fairness. A breach of procedural fairness includes such things as the Associate Dean failed to:
- Follow the university rules and regulations in a way that supported your right to a fair process.
Appeal Letter
Appeal Letter: Dear Board studies,
I am writing a second-level appeal because I believe there was confusion regarding my appeal letter and I want to clarify my appeal grounds.
The Associate Dean stated that appeals are only granted if there are extenuating circumstances such as a significant physical or psychological event. My request meets the term of this statement since the time of my illness was highly severe and significant. It was an illness beyond my control that impacted my performance as well as my daily well-being and function. Being sick for the month of November was beyond my control
The Associate Dean also states that the documentation I supplied does not indicate how long my illness impacted my classes past mid-November. My explanation for this is that I did not know the illness would last for the rest of November and I was not able, nor capable of getting a doctor's note for the end of November. Because the doctor only assessed me once, she could not write me another letter for the whole month of November. I did receive short-term academic consideration from the first medical note, but it was not enough since I was still ill for the rest of the month and did not have a doctor available to me to assess me and write another consideration note. I could not leave my home because of the illness and my family does not have access to a family doctor. The doctor came as assessed me and made me a note for Mid-November. But She can not write me another note regarding my illness for the whole month of November since I could not see her assess me passed Mid-November.
The Associate Dean also made a note that I could have utilized academic consideration to successfully complete my courses when I was feeling better, but I could not get long-term academic consideration without another medical note. Also, as stated in my appeal I began to feel better around the time of writing exams (beginning of December). So with the struggle of being unable to get a medical note from a doctor, I felt the pressure to go in and write my exams anyway given the circumstances I had.
I feel that the Deans decision did not follow procedural fairness since I feel that I have not been heard. I believe that my circumstances do meet the rules and regulations because I was willing to seek accommodation for my illness, but I was not able to receive it due to not being able to get a medical note. because It is clear in my appeal that I indeed made an effort to try and do well in my courses regardless of my circumstances.
