Decision Letter
Appeal Number: 2576
Decision Date: September 7, 2016
Associate Dean: Sue Blake
Student Name: Kieran Paitich
Student Email: 11krp4@queensu.ca
Dear Mr. Paitich:
I have carefully considered your request to have your appeal heard after the 21-day timeline for submission. After reviewing your file I have decided to deny your request.
The appeal timeline is in place to give students sufficient time to respond to an academic decision. The 21-day timeline offers students time to seek academic counseling, to write up and submit an appeal, and to collect the supporting documents necessary to the appeal. Further, the appeal timeline is in place to ensure that decision making takes place in a timely manner, allowing students to continue in their academic programs without ongoing concern for unresolved matters.
Exceptions to this regulation can only be granted in cases where extenuating circumstances beyond a student's control render the student unable to appeal within the specified timeline. The student must be able to show that the extenuating circumstances were ongoing. The student must also be able to demonstrate that these circumstances prevented the student from acting between the time the original decision was received and the time at which the appeal was eventually initiated. An appeal of this type should include a presentation of the specific reasons for the delay and should include documentation which supports the reason for the delay.
There is no explanation provided as to why you were not able to submit your appeal to waive the requirement to withdraw by the June 14th deadline. There is also no recent documentation supplied to confirm the difficulties you describe in your letter.
I will further note that your appeal last September to waive the requirement to withdraw for one year was granted with very specific recommendations that you must take responsibility for your studies, monitor your workload, seek advising and drop courses by the deadlines. There is no evidence from your file or current appeal that you followed through on any of these guidelines. From your transcript, you failed two out of three courses each term and only contacted an academic advisor in the Faculty Office for assistance in mid-August.
Your current appeal claims that you were not adequately accommodated for your ADHD. However, you were advised in your last appeal decision letter to take the responsibility to register with QSAS to ensure that you had the proper academic accommodations put into place for 2015/16.
Finally, your appeal decision letter of 30 September 2015 also warned that any further appeals based on the same circumstances would not be successful, as you needed to manage your situation so that your academics would not continue to be negatively affected. As a result of the additional failures incurred in 2015/16, your GPA remains at 0.65. For these reasons I cannot reasonably waive the appeal deadline, nor can I consider waiving the requirement to withdraw for a minimum of three years.
If you wish to appeal the Associate Dean€™s decision to the Board of Studies, you must submit an appeal to the Board of Studies within 21 days of the date this decision was sent. Guidelines for appealing to the Board of Studies and the appeal form can be found at: http://www.queensu.ca/artsci/students-at-queens/academic-appeals (click on €œBoard of Studies€) Do not use the on-line application for this process. You may contact Mr. Harry Smith, Office of the Ombudsman for advice on matters of procedure and on obtaining a representative. His office is located in room 421 Robert Sutherland Hall and he can be reached by phone (533-6495) or e-mail (ombuds@queensu.ca).
Sincerely,
