Dear Aanandini,

As part of the standard process when appealing to the Board of Studies, the Associate Dean (Academic) reviews your appeal submission. I have carefully considered your appeal to waive the one-year petition deadline for courses prior to 2019.

The new documentation attests persuasively to the identification of a new diagnosis letters dated July 2023. This suggests a need for retroactive accommodation for a previously unaccommodated disability. For this reason, it seems clear that you are in need of a remedy. I will note however that given that these courses are no longer in progress and that in some cases a significant amount of time has passed that the options for remedies may be limited. As the Ontario Human Rights Code notes (8.4.3 Accommodation after a deadline, test or course has been completed) the obligation for retroactive accommodation is tempered by a recognition that “the duty to accommodate is not limitless. There may be narrow circumstances where it may not be reasonable or possible to accommodate a student’s disability, such as, for example, where too much time has passed since the person took a course, attended the institution, etc.”

With this in mind, I have decided to grant the waive of the one-year deadline and allow the petitioning of courses prior to 2019.
